Supertech Resolution: Supreme Court Roadmap and IRP-Led Process Bring Hope for Homebuyers

Mumai: The recent developments surrounding Supertech Limited mark an important step toward resolving one of the most closely watched real estate insolvency cases in the country. With the intervention and guidance of the Supreme Court of India, a clearer and more structured pathway has begun to emerge for the completion of long-stalled housing projects.


At the heart of the process is the commitment to safeguard the interests of thousands of homebuyers who have been waiting for years for their homes. During the insolvency proceedings, the process supervised by the Interim Resolution Professional focused on identifying practical solutions to restart stalled projects while keeping the interests of homebuyers at the centre of the resolution framework and restore confidence among stakeholders.


One of the key developments in this process was the proposal to bring in NBCC (India) Ltd to take up the responsibility of completing several stalled projects. The proposal received approval from the National Company Law Appellate Tribunal, and the Supreme Court later upheld the approach, observing that the decision was neither unfair nor contrary to the Insolvency and Bankruptcy Code.

To ensure transparency and accountability in the execution process, an Apex Court Committee has been constituted to oversee the progress of the projects. The committee is chaired by Hitesh Goel, who is serving as the Interim Resolution Professional. Its members include Sachin Dev, nominee of Union Bank of India; Praveen Nijhawan, nominee of L&T Finance; and Vijay Kumar Chaudhary, nominee of NBCC (India) Ltd. An independent real estate or construction expert is also expected to join the committee.
The committee will play a crucial role in monitoring project execution, supervising the use of funds, and ensuring that construction progresses in a transparent and time-bound manner.
With judicial oversight, institutional participation, and a clear focus on homebuyers, the evolving framework offers renewed hope that stalled developments will finally move toward completion. 

For thousands of families awaiting possession of their homes, this process represents not just legal progress, but a long-awaited step toward resolution
